Ex-con wins $18,607 in rectal thermometer lawsuitMONTREAL – A judge has ordered a Montreal hospital to pay an ex-con $18,607 after his temperature was taken with a rectal thermometer while he was handcuffed to a bed.
The judgment, however, fell far short of the $200,000 John Beshara (above) had sought after claiming he'd been "violated."
In September 2006, Beshara was serving time in the north-end Bordeaux jail for robbery.
He ingested what he thought was methadone, part of a treatment for heroin addiction, court documents say.
In fact he had mistakenly swallowed another inmate's meds, which landed him in a hospital.
On the second night, as the inmate lay cuffed to his bed, a male nurse entered and Beshara became aggressive, the court ruling says.
Correctional officers held Beshara down and the nurse took his temperature.
The judge ruled Beshara hadn't been sexually assaulted, but he still deserved compensation because he was probed without his consent. Source: The Toronto Sun, February 11, 2014.
